Welcome to ProBeauty AI (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of our platform, services, and features, including our website, iOS app, and Android app. By accessing or using ProBeauty AI, you agree to comply with these Terms.
1. Overview of Services
ProBeauty AI is an innovative business suite powered by specialized AI agents, designed exclusively for beauty professionals. Our platform provides tools for:
- Customized AI tools tailored to beauty businesses
- Client management, including data and progress images
- History tracking for client treatments
- AI-driven automation of client interactions via Instagram, Facebook, and WhatsApp
- Appointment booking and scheduling
- SMS notifications and reminders
2. Eligibility
ProBeauty AI is designed for use by beauty professionals. By using our platform, you confirm that:
- You are at least 13 years of age (or 16 in the EU)
- You are using the platform for professional purposes only
- You have the authority to agree to these Terms on behalf of your business, if applicable
3. Subscription Terms
Pricing
Our subscription plans include:
- Base: $24/month
- Pro: $40/month
- Max: $80/month
- Enterprise: Custom pricing
Auto-Renewal
Your subscription automatically renews at the end of each billing period unless you cancel. You will be charged the current subscription price on each renewal date. By subscribing, you authorize us to charge your payment method on file for recurring payments.
How to Cancel
You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will retain access to all features until then.

Refund Policy
All subscription payments are non-refundable. When you cancel, your subscription remains active until the end of your current billing period. No partial refunds are provided for unused time. For billing questions, contact billing@probeauty.ai.

Price Changes
We may change subscription prices with at least 30 days' notice via email. Current subscribers will continue at their existing rate until their next renewal after the 30-day notice period.
4. User Content & Intellectual Property
Your Content
You retain all ownership rights to images, data, and information you upload to ProBeauty AI. By uploading content, you grant us a limited license to:
- Process and store the content to provide our services, including sending it to third-party AI service providers (such as OpenAI, Together AI, Replicate, and Soniox) for processing, analysis, and generation
- Display content back to you within the app
- Create backups for data integrity
We do NOT use your content to train AI models. Third-party AI providers process your data solely to return results to you through the app and are not authorized to use your data for model training.
Our Content
All ProBeauty AI content, features, branding, and AI-generated recommendations are our intellectual property. You may not copy, modify, distribute, or reverse-engineer any part of our platform.
5. User Responsibilities
Users are responsible for:
- Ensuring compliance with all applicable local, state, and federal laws regarding client data and consent
- Obtaining appropriate consent from clients for storing and managing their personal information and progress images
- Using ProBeauty AI only for lawful, professional purposes
- Maintaining the security of your account credentials
6. Prohibited Uses
You agree NOT to:
- Use the platform for any illegal or unauthorized purpose
- Attempt to reverse-engineer, decompile, or extract source code from our AI models or software
- Scrape, bulk download, or systematically extract data from the platform
- Share your account credentials with others or allow unauthorized access
- Use automation tools, bots, or scripts to access the service (except through our provided APIs)
- Harass, impersonate, or harm other users
- Upload malicious content, viruses, or harmful code
- Violate Meta's, Google's, or any third-party platform's terms of service
7. AI Services Disclaimer
ProBeauty AI provides AI-powered tools and suggestions, NOT professional advice.
- Not Medical Advice: We are not medical professionals. AI-generated beauty recommendations are suggestions only and should not replace professional medical advice, diagnosis, or treatment.
- Accuracy Not Guaranteed: AI suggestions are based on patterns and algorithms. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.
- Professional Judgment: Always use your professional judgment when applying any AI recommendations to your clients.
8. Third-Party Integrations
ProBeauty AI integrates with third-party platforms, including:
- OpenAI (AI chat, text generation, image analysis, and document processing)
- Together AI (AI image generation)
- Replicate (AI image generation, style transfer, and background removal)
- Soniox (audio transcription)
- Meta APIs (Instagram, Facebook, WhatsApp)
- Google services (Drive, Calendar)
- Stripe (payment processing)
- Twilio (SMS services)
You must comply with the terms and conditions of these third-party platforms when utilizing such integrations. We are not responsible for changes to third-party services that may affect functionality.
9. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. We may:
- Perform scheduled maintenance (we'll notify you when possible)
- Experience occasional downtime due to technical issues
- Modify, suspend, or discontinue features with reasonable notice
10. Limitation of Liability
ProBeauty AI is provided “as is” and “as available.” To the maximum extent permitted by law:
- We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
- We are NOT liable for any indirect, incidental, special, consequential, or punitive damages
- We are NOT liable for loss of data, profits, revenue, or business opportunities
- We are NOT liable for issues caused by third-party services (Stripe, Meta, etc.)
- We are NOT liable for any decisions made based on AI-generated recommendations
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
11. Indemnification
You agree to indemnify, defend, and hold harmless ProBeauty AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of the service
- Your uploaded content
- Your violation of these Terms
- Your violation of any third-party rights
12. Account Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in illegal activity
- Abuse the service or other users
- Fail to pay subscription fees
- Provide false information
Upon termination, you will lose access to your account and data. We may retain certain information as required by law.
13. Data and Privacy
Your use of ProBeauty AI is also governed by our Privacy Policy. By agreeing to these Terms, you acknowledge that you have read and understood our Privacy Policy.
14. Dispute Resolution
If you have a dispute with ProBeauty AI:

- Binding Arbitration: If unresolved, disputes will be settled by binding arbitration (no class actions)
- Governing Law: These Terms are governed by the laws of the State of Florida, U.S.A.
By using ProBeauty AI, you agree to submit to the exclusive jurisdiction of the courts in Florida for any disputes not subject to arbitration.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the updated Terms.
